Under the reform of the new immigration policy, what are the new changes in Victoria's 188A transfer


According to the 2020-21 immigration plan report issued by the Australian Department of Home Affairs, as of June 30, 2021, China has become Australia's largest source of immigrants in the last fiscal year, and 188 business immigrants are still the preferred immigration category for investors!



In the 2020-21 fiscal year, the Australian government has made major adjustments to business immigration, and states have also announced policy rules one after another. As a hot spot for business immigration, Victoria, what are the latest requirements and changes for 188A applications and 188A transfer to 888A?


Victoria 188A Business Innovation Category Application Requirements


Duration of stay: up to 5 years; longer stay: hold for 3 years and meet the conditions to submit an 888A permanent residence visa application;


Nomination approval time: 188A state guarantee approval time will be completed in about 12 weeks;


EOI score requires 65 points;


Language: Vocational English (Vocational English) IELTS 4 points of 5 or equivalent;


Academic requirements: one of the conditions is met

a. Undergraduate degrees in STEMM categories (Science, Technology, Engineering, Mathematics, Medicine);

b. Master of Business Administration MBA


If you cannot meet the academic requirements, you need to have at least 3 years of business experience in key fields (Target Sectors), covering categories: health, medical research and life sciences, digital technology, agricultural products, high-end manufacturing, new energy, emission reduction and circular economy.


Victorian 188A to 888A State Guarantee Latest Requirements


1. Meet the requirements of Immigration 188A to 888A:


Hold a 188 visa for 3 years or more;


Have lived in Australia for more than one year in the three years preceding the application;


In the 12 months before the application, the sales of the Australian company are more than AUD 300,000;


Shares in an Australian company:


Sales are in the range of 300,000 to 400,000 Australian dollars, accounting for 51% of the shares;


Sales of more than 400,000 Australian dollars, accounting for 30% of the shares;


In the 12 months before submitting the application, meet 2 of the following 3 requirements:


Invest more than A$200,000 in an Australian business;


Assets in Australia of more than 600,000 Australian dollars;


employ 2 full-time employees;


2. Meet the requirements of the Victorian State Government 188A to 888A:


For two years of business, a turnover of not less than 1 million Australian dollars every 12 months or continuous employment of two full-time employees for 24 consecutive months (real estate development, gift shop, convenience store, cafe or restaurant becomes an unacceptable business type)


Key Time Nodes of Victoria's New and Old Policies


1. Applicants who submitted the Victorian state passport before July 19, 2019:


No mandatory hiring of employees, business innovation, etc.;


The business turnover should be more than 300,000 Australian dollars in the second year.


2. Applicants who submitted a Victorian state visa between July 19, 2019 and December 31, 2020:


Requires continuous employment of one full-time employee (more than 12 months);


The business has a turnover of more than 300,000 Australian dollars in the second year.


3. Applicants who submitted a Victorian State ID between January 4, 2021 and July 1, 2021:


Requires continuous employment of two full-time employees (24+ months); or


In the two years of the business, the turnover in each 12-month period must be more than 1 million Australian dollars;


Business innovation (process innovation or product innovation).


4. For applicants who submitted the Victorian State Charge after July 1, 2021:


Requires continuous employment of two full-time employees (24+ months); or


In the two years of the business, the turnover in each 12-month period must be more than 1 million Australian dollars;


Gift shops, convenience stores, cafes or restaurants cannot be used as business types for later transfer to 888A

Victoria State Guarantee Keyword Definition


1. Division of policy time points


According to the official reply from Victoria, all 188A/B/C visas, the policy time point is divided into "Submit-" 188 state guarantee time, rather than approved or nominated 188 state guarantee time. The time to submit the 188 state guarantee can be found on the state guarantee application commitment letter. 2. Eligible Full time Employee


Full-time employees must work at least 30 hours per week; employees who work part-time 20 hours per week count as half-time employees; temporary employees cannot meet the work requirements of full-time employees.


Full-time employees must meet the following requirements:


• Holders of Australian citizens, Australian permanent residents or valid New Zealand passports;


• Cannot be a family member of the applicant.


3. Economic benefit


a. In non-export business, any business primarily operating at a Victorian address will be considered an economic contribution.


b. Applicants who are engaged in an export or e-commerce business must demonstrate how they make an economic contribution to the Victorian economy, such as:


· The value of Victorian exports of goods and services



· Job creation or retention in Victoria, including benefits to suppliers


· The economic benefits of the company in the local area


· Assist Victorian enterprises to export products or expand export markets and solve market vacancies


· Merely paying payroll tax income and Goods and Services Tax (GST) is not considered an economic contribution to Victoria.


4. Parallel Exporting


Parallel export is the practice of selling products to overseas markets without the express consent of the trademark owner.


This export is not permitted when applying for a Victorian sponsorship. The reason for excluding such exports is to ensure that business migrants are exporting with permission from Victorian product manufacturers or trademark holders, and to encourage migrants to interact with brand owners and work together to develop new markets.
